Distant Sale Contract

This contract has been issued to comply with the provisions of the Regulation on Procedure and Principle of Distance Sale Contracts published in the Official Gazette numbered 25137, dated 13.06.2003. The purpose of this contract is to define the rights and obligations of the parties in accordance with the relevant regulation regarding the distance sale of products by the SELLER to the BUYER.

ARTICLE-1 SUBJECT

Subject Matter This contract covers the sale and delivery of the product by the SELLER to the BUYER, and sets out the rights and obligations of both parties in accordance with the Regulation on Procedure and Principle of Distance Sale Contracts and the Consumer Protection Law (numbered 4077). The characteristics of the product, as well as its selling price, are provided in the following sections.

ARTICLE-2.2 - Buyer Information

The BUYER is a member of the excursions site named www.tourmoni.com. The address and contact information provided in the subscription will be taken as the basis.

ARTICLE-3 - Product Information

This section comprises information regarding the type, quantity, brand/model, color, selling price, and payment method for the product when the order is finalized.

ARTICLE-4 General Provisions

4.1 – The BUYER acknowledges and agrees to have fully understood the preliminary information on the basic qualifications, selling price, payment method, and delivery of the product(s) as indicated in Article 3. The BUYR also confirms this understanding in the electronic environment. 

4.2 – Tour Moni Travel Agency LLC shall deliver the product(s) subject to this agreement to the BUYER or the person/legal entity at the provided address within the time period specified for each product in the preliminary information, based on the distance of the BUYER's current location. The delivery period should not exceed the legal time limit of 30 days, for any reason whatsoever. In exceptional circumstances, the delivery period may be extended by an additional 10 days, provided that prior notice is given to the BUYER. 

4.3 – If the product subject to the contract is to be delivered to another person/legal entity other than the BUYER, Tour Moni Travel Agency LLC shall not be liable for any refusal of delivery by the said person/legal entity. 

4.4 – Tour Moni Travel Agency shall be responsible for delivering the product(s) that meet the qualifications set in the order and are in good condition and complete. The guarantee certificates and user guides, if any, should also be included in the delivery. 

4.5 – If the price of the product is not transferred to Tour Moni Travel Agency by the issuer bank or financial institution due to an illegal use of the BUYER's credit card by an unauthorized person without the BUYER's consent and fault, the BUYER shall return the delivered product to Tour Moni Travel Agency LLC's contact address(es) within 3 days. In such a case, the delivery cost shall be borne by the BUYER.

4.6- If Tour Moni Travel Agency fails to deliver the product(s) within the specified time period due to force majeure, adverse weather conditions, transportation disruption, or any other reasons, Tour Moni Travel Agency LLC shall notify the BUYER. The BUYER shall be entitled to select one of the following options: cancel the order, replace the contract product with an equal product, and/or postpone the delivery time until the condition is eliminated. If the order is cancelled by the BUYER, the paid amount shall be fully reimbursed to the BUYER in cash within 10 days.

Right of Withdrawal

The BUYER shall be entitled to withdraw from the contract within (7) days following the delivery of the product(s) subject to the contract to the BUYER or the person/legal entity at the provided address. In order to exercise this right, the BUYER shall notify Tour Moni Travel Agency LLC within this period via fax, e-mail, or phone. The product(s) shall be unused and in accordance with the provisions of the regarding article. If the BUYER exercises this right, it is obligatory that the carrier's delivery notice evidencing the shipment of the product delivered to the third parties or the BUYER, as well as the original of the product invoice, are sent to Tour Moni Travel Agency LLC's contact addresses. Within 7 days following the receipt of the said documents, the price of the product shall be reimbursed to the BUYER. If the original invoice has not been sent, VAT and other legal liabilities, if any, shall not be reimbursed to the BUYER. The return costs regarding the product(s) subject to withdrawal shall be borne by the BUYER.

The consumer can request the cancellation of the payment on the grounds that the credit card or payment card has been used by unauthorized persons, illegally and without his/her consent. In this case card issuer returns the payment to the consumer within 10 days following the notification of the objection. 

Regarding the execution of this contract, the Consumer Courts located in the residential area of Tour Moni Travel Agency LLC as well as the arbitration boards as announced by the Ministry of Industry and Trade are authorized. Upon placing the order, the BUYER is deemed to have accepted all terms and conditions of this agreement.
